By accessing or using MarketGeist (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MarketGeist provides an AI-powered market research platform that generates competitive intelligence, trend analysis, industry reports, and related business intelligence. Reports are generated algorithmically and should be used as a research aid, not as the sole basis for major business decisions.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Payment

Paid plans are billed monthly or annually in advance. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes
  • Attempt to reverse-engineer or scrape the platform
  • Resell or redistribute reports without our written consent
  • Interfere with the security or performance of the Service

6. Intellectual Property

MarketGeist owns all rights to the platform, software, and underlying technology. You own the reports and outputs generated from your account, subject to our right to use aggregated, anonymized data to improve the Service.

7. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not warrant the accuracy, completeness, or fitness for purpose of any generated reports. Market research outputs are AI-generated and should be independently verified for critical decisions.

8. Limitation of Liability

To the maximum extent permitted by law, MarketGeist shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the fees you paid in the 12 months preceding the claim.

9. Termination

Either party may terminate at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your access to the Service will cease.
